Appeal Rights

 

If Providers Choice, Inc. should ever propose to terminate your participation with the Child & Adult Care Food Program (CACFP) for cause, you have the right to request an administrative review of the proposed termination. This administrative review presents a final opportunity for you to present additional information regarding your serious deficiency determination and failure to accomplish the specified corrective action plan.

If you would like to request an administrative review, notice of your request must be presented in writing and received in the PCI office no later than 15 days from your receipt of our certified letter to you advising of our proposed actions. Your request must be sent to the Director of Business Operations, Providers Choice, 7301 Ohms Lane, Suite 210, Minneapolis, MN 55439. If you choose not to request an administrative review your participation in the CACFP will be terminated effective 16 days from your receipt of this certified letter. If you do request an administrative review you will have 30 days from your receipt of this certified letter to submit any pertinent documentation to the Appeal Official. Once your documentation is received the Appeal Official will examine your case and decide whether or not to uphold your proposed actions. The decision of this Appeal Official is final, immediate and cannot be appealed.

Please note, Providers Choice will not terminate your participation and will continue to process and pay any valid claims submitted for 15 days from the date of your receipt of this certified letter (if you do not request an administrative review) or until the Appeal Official has made a final decision on your appeal (if you do request an administrative review).

If you are disqualified from CACFP participation your name will be placed on a National Disqualified List, which is a list maintained by the Federal government of providers who are blocked from enrolling in any of the United States Department of Agriculture’s (USDA) Child Nutrition Programs anywhere in the USA for a period of up to seven years.

A decision to voluntarily terminate your participation in the CACFP while having been declared seriously deficient in your operation of the program will also result in your name being placed on the National Disqualified List.
